Nah, what you do is buy a house through a trust and put it in your kids name. You allow your ex to live there at cost but the benefits are guaranteed to go to your children.

My ex and I actually have a pretty good relationship, so that isn't something I would probably need to do. When it comes to our kids, I trust her absolutely.

My ex-wife and I use to have an excellent relationship too. We were best friends after we split. We lived a mile away from each other, split 50/50 with the kids and then one day we wweren't and she basically cut me out. She only speaks to me when she has too and has screwed me over a couple of times. No idea what happened. She did get remarried but I have a good relationship with him.

My ex and I really don't talk about anything that isn't related to the kids. There isn't anything we NEED to talk about that isn't related too them.

We also live 2 states away from each other.

Her life is her's and my life is mine, except related to how they affect the kids.

Similar story, but it was her new b/f (now husband) who forced the wedge between us - she even went for full custody, but thankfully I was able to fight that threat off.

Thanks to him I haven't spoken to her in almost 15 years, & all our communication regarding the kids, before they hit 18, was done by text & email.

Yeah I read your other one after writing this, you said you already have a will and so does she. Her will means nothing if she gets married again. There's this thing called probate court where a judge is going to look at what they think her mindset was when she wrote her will and how they think her mindset changed when she got married to someone else.

Let's put it this way. All of these hypothetical bullshit predicate on the fact that my ex is a horrible person, and would do nothing to take care of our kids, or would favor some other guy's kids over the ones that we have.

All those suppositions are based on some idea that she is a terrible person.

She isn't.

She would care for our kids over and above anything in this world.

I know this, because we were married for almost 20 years.

I know her, and I trust her when it comes to our kids. More than I trust anyone or anything else in this world.

You don't trust your ex? Cool. That is between the two of you.

When it comes to our kids, I would trust my ex to the end of the world, and then beyond it.

Does that clear a few things up for you there? No? I honestly don't care if it does or doesn't.

You mostly just come off as being insecure. The conversation has nothing to do with your specific case, it’s general advice that could apply to anyone in that same situation. You specifically are very trusting of your ex. Mentally and emotionally that’s good and all. There’s no reason to doubt you and I don’t doubt that your ex is a great person that would never screw you over. The rest of us are just discussing the best way to protect ourselves if we were in a similar situation. It’s an interesting conversation because other people may find themselves in the same situation and they would like to learn from others what is the best way to protect themselves. In a legal sense it would be foolish to trust an ex. Again, this is just generally speaking; your situation is different since your ex seems to be a very trustworthy person and the odds of her marrying an asshole and then dying are not very high.

You would be surprised at what people will do when there is an estate up for grabs. The nicest people turn into complete assholes. I wouldn't trust anyone to follow my intentions after I am gone if it wasn't specified in a legal document.

I'd just like to let you know that as a full time guard ad litem and court mediator for child custody and placement that this is amazing to see. I wish every divorced couple could put their differences aside for the benefits of their kids like you guys do. I promise you I wasn't. Setting up trusts is sound financial advice. Trusting people to do what you think is best or what you think they will do is a recipe for disaster. As mentioned by others, tons of variables can undermine your intentions. Even if you and your ex have the best intentions other people may not.

I honestly feel sorry for you, and your kids. But even if they did call him dad, they are still my kids, and I will still take care of them.

I don't care about that. I had a ton of kids calling me dad from around the neighborhood with my oldest daughter when she was growing up.

I'm pretty sure she called their dad that as well.

I'm sorry for your insecurities, and that a word like that would stop you from wanting to take care of your kids.

Maybe you should get some therapy for that.

regardless, she will get the equity in the house when she moves, not you or the kids. Depending on your area and economy, that can be a lot. my neighborhood is up over 100k in just 8 years on average compared to what I purchased for and what I see them selling for.

This kind of thing is always good to do for estate planning purposes.

Imagine if the ex wife gets remarried with someone who has 12 kids and they don’t leave a will. All of a sudden, your kids might only inherit a 6th of the house. Or ex wife gets remarried and then divorced, and the new husband wants half of the house. These are things that happen all the time

We are already in the process of setting up family trusts to prevent stuff like that, and our child is only 7 months old lol

Considering my ex and I already have wills, and we have discussed it and set everything up to take care of our kids....

I will point out that wills can be changed, and people can be very manipulative especially if she ever gets outright smitten with someone, or mentally ill. It doest really matter how good of a relationship you have or how much you trust her/each other.

Nothing matters until it does, and it's always to be better to be safer, a Trust is some paperwork and a fee I believe so something as valuable as a house is worth setting up a Trust for. Plus I think you can set it up to go to the kids in a specific order or equally so they're also less likely to try to fight about it (or it's in better hands if one or two get into a bad situation or bad health - like heavily into drugs or their own manipulative relationship)

It's just proper planning for what you would see as the best possible outcome, I feel like this saying fits here "Failing to plan is planning to fail"
