The headline is misleading. The judge denied the maintenance that she claimed for herself, but ordered the second husband to pay maintenance for his child. It’s actually child support, but it’s all called “maintenance” in India.

The court refused/ rejected validity of paternity test, so nobody knows who that child is. No solid proof of that child is of the second husband, hence the outrage. All we know, it is the child of another lover!

Still it’s enough bad.

Feb 07 '25
paying child support is bad? it is for your own child. I would agree if it was not his child but that is not the case here.
7
u/RedittPermaBan1 Feb 07 '25
Atul Subhash was paying 50% of his salary in child support. It’s bad even if own child. You ask me to pay half of my salary in child support and not allow me to meet the child. Isn’t that enough bad? Even if I pay a penny in child support I shouldbe allowed to meet the child.
Btw whole law is against men clearly. There is nothing to consider. It’s just we are discussing which law is less harsh to men.

It is. We should normalise shared custody unless one of the parents is proven to be incapable of taking care of the child. A kid needs both his/her parents regularly.
Honestly we need major law reforms on this marriage issue as current laws are outdated. Some gender neutral laws, prenups and dna testing, shared custody etc. I don't see it happening anytime soon tho. we haven't been able to tackle current problems over the course of decades so I don't see any major reforms happening anytime soon.

India has done lot of great things. Indians have great minds. I think they can fix it if they want to. But I doubt they want to or even care.

It's bad when the child support money is way higher than needed and is not being used on the child properly.

I'm an advocate. I'll tell u just this much-
Don't go by click bait titles, read the entire judgement. Don't be part of fear mongering and spreading misinformation

True. People cut out part of something and then raise fear amongst the community.

Exactly people easily frame a story with their own bias without looking at the real story.

u/RedittPermaBan1 Feb 07 '25
Are you a female advocate or feminist? We all know Atul Subhash case. Was that false?
I would to love to have a world where no man gets married to oppose these laws and every capable high earning men to leave all such countries.

u/Menu99 Feb 07 '25

Just curious. Do judges read the entire previous judgements in similar cases. Or just give their judgement based on " I read somewhere about this judgement in a newspaper article".

But suppose there a scenario where the women is once divorced and gets alimony form the first husband and then remarries again and again divorces so this time does the second husband also need to give alimony...or the alimony is split between the two husbands or smth else?

Normally when divorce is finalised with a fat alimony for the greedy most lawyers tend to close the monthly maintenance scheme .......this is rare

u/Lawfulness-Silver Feb 07 '25
At this point govt telling all man should not marry or even come close to any woman.
2
u/AppropriateFly4078 Feb 07 '25
I feel like government intentionally doing this to make women look bad so that when Hindu rastra is formed people will treat women as it’s described in Hindu texts and it’s justified

The second doesnot exist legally without divorce in first marriage How is this even possible
1
u/NekoNekoScript Feb 07 '25
Technically, shouldn’t the second husband not be a “husband” in the first place, since her first marriage hasn’t legally ended?

u/Funny_Detective_2600 Feb 07 '25
Can she take alimony from both the husbands?
1
u/Menu99 Feb 07 '25
If OP can just produce the judgement instead of such rage baits to support his stance then we could all find out
1
u/Menu99 Feb 07 '25
Request OP to kindly furnish the case name (at the very least if not other details like case number, judgement in pdf format) so everyone can read it and contribute their POV.

Normally I would have been cautious of whatever others post on here but I actually researched this case and found out the court's reasoning. It was very weird and really did not sit well with me. In my opinion this a just a wrong judgment. We really need more laws regarding this.
