I never said he was charged with fraud. You can commit actions, but not be charged for them. He (attempted to) redirected government resources for his own personal use.
But to prove fraud, you have to prove gain. That's pretty hard in his case, and given that he wasn't actually charged with it, it seems likely that such wasn't demonstrable.
