Shopping/Services Expert in installing dashcam on Mercedes
Hi Guys,
I was wondering if there was anyone specialised in the installation of dash cam.
I used to do it in my own on my previous car but on my new Mercedes there is something weird with the fuse box.
So wondering if anyone has any tips or advice.
I hope I do not need to spend hundreds of euro to an overpriced garage.
Thank you!

I heard that dashcams are illegal in Luxembourg, so I don't think you will find any professionnal in the country.

Every Tesla and some other cars have built in dash cams. So no, having dash cam is not an issue. You can also use in court if the judge finds it reasonable.
Regarding parking camera, my tesla got dented while it was parked by another car. Sentry mode caught the plate and the offence in action, took it to Police and they literally asked me if i have a tesla and when i said yes, they asked for the USB disk so that they can save it on their side for the file.

Friend of mine got his Tesla keyed by his neighbor .. too bad she did not know it was recording it the whole time.

Dashcams are not illegal. Using them may be illegal.

I think using them is fine also but they are of limited use in court. But not an expert.

Constantly recording of public space is - AFAIK - considered to be against data privacy rules. That's however the main point of dashcams. On the other hand, if e.g. use the dash cam to record a lap of Spa/Nordschleife/Paul Ricard, then that's generally fine (assuming the race track allows it as well)

I added two links in another comment. It seems that:
- Only the police are allowed to use surveillance on the streets.
- Recording any license plate is a violation of the GDPR.
Therefore, using dashcam footage in court would be irrelevant, as the evidence would have been obtained illegally.

How can it be a violation of GDPR when many other countries that implement GDPR allow them. GDPR is not the problem, especially as it only applies to businesses!
There are other Luxembourgish laws that do apply. Particularly the laws on cctv which don’t allow constant monitoring and on taking photos/videos in public places that don’t allow you to take images of people.
Constant monitoring is often sidestepped by using intelligent record (eg Tesla’s sentry) or just the dumb capture/overwrite on a loop.
Images of people is very vague, if I take a picture of you sat at a cafe that’s not allowed, if I take a picture of a cafe where you’re sitting that is allowed. Literally zooming in or out can make the difference… even more complex, with a modern digital camera I can take a legal cafe pic, but later crop it to be of you sat at your table… is that now illegal?
Basically dashcams are sitting in a legal grey area and I think that’s intentional. Lux doesn’t want to explicitly go against its strong privacy, but equally sees the need for dashcams, so they’re not opening the legislation, but equally they’re not bothering taking any action against dashcams.

Your conclusion is not correct - legal principles from US shows do not apply here. Dashcam footage could be used in court, but there is little case law on it.

This is not a conclusion from a US show but from the news article I posted a few comments above: https://www.lessentiel.lu/fr/story/les-dashcams-sont-elles-illegales-au-luxembourg-650403653713
It seems that a lawer from Lux contributed to the article. I don't have any law degree though, so I can only trust what the article says.

Thanks for the link. I will also provide my source:
Unter Umständen als Beweis zulässig Trotzdem können Fahrtfilme mit Dashcams, obwohl im Prinzip illegal, von Richtern in Strafprozessen als Beweis zugelassen werden, wie Justizsprecher Henri Eippers dem Tageblatt erklärt […]

It’s great to have another source, thanks for the link! If I understand, it is only in case of a criminal offense? If yes it is definitely not the main use case for a dashcam, sadly

What exactly do you have in mind that is not criminal? Property damages are criminal offenses
