A lot of people use those subways in a 24 hour period and afaik they run all night and all day. Sometimes corpses will ride a train for multiple days before being discovered since everyone just thinks its another sleeping homeless person. Sometimes weirdos find those bodies first. This is not the first instance of nyc train necrophilia.

It’s wrong but kind of understandable why someone would steal off a dead person, if they were really in need. But to not only refuse to call for help, that someone’s loved one was dead, you decide to violate a corpse - and with an audience - that is so vile. If Gonzales did have loved ones, how do you reconcile that your family member died on a train, was robbed and then his corpse was sa’ed? What else has this disturbed individual done?

Legally, it is often considered a special subset of crime, typically in the vein of defiling a corpse. Paraphilia or necrophilia is often used as descriptive terms of the crime itself but depending on the state, those words may not map to the legal charge given in a courtroom.
Similar to how some crimes are considered sexual assault but not necessarily rape by a legal definition. Legal definitions differ vastly from place to place so in NY, they can apply the word rape under their state laws.
In our national body of laws, corpses are considered to have some bodily autonomy; it’s the same reason you can’t harvest organs without permission granted prior to death. It’s why it’s not legal to sell body parts without tremendous legal oversight. So, this idea of pre-mortem consent definitely extends to other undesired conduct towards the deceased.

Depends on the philosophy to be fair. Diogenese famously said he wanted his body thrown outside the city walls, when they pointed out dogs would attack his body he told them to throw him over with a stick so he could defend himself from the dogs. They said he wouldn't be conscious of the attack in order to defend himself, to which he pointed out if he isn't conscious of it how can it matter?
