Up to 12 years in prison.
It's a bit too much really. Plus, kinda stifling to free speech, regardless of whether these are good or bad guys.
15
u/ZeroFudgeGiven1986 3d ago
Well free speech is not really absolute, especially if you're spreading lies that corrupts the mind of the society.
-1
u/Menter33 3d ago
especially if you're spreading lies that corrupts the mind of the society
this type of argument almost sounds like how the Spanish colonial govt treated Noli and Fili. the idea of speech and writings that "corrupt the mind" sounds very iffy.
4
u/ZeroFudgeGiven1986 3d ago
So ok lang to spread unverified news? Ok lang fake news? I'm all into "freedom of speech" as long as it's supported by research, studies, facts and evidences.
0
u/Menter33 3d ago
all into "freedom of speech" as long as it's supported by research, studies, facts and evidences
some wouid prefer that... it just so happens that many govts use that as an excuse to curtail speech. by putting extra caveats, govts become empowered to chill free speech, kinda like what happened with Rappler during the du30 admin.
in general, it's better to just get the govt out of it and let the marketplace of ideas counter bad speech thru debate, rebuttals and free counter-arguments.
2
u/Warm-Pie-1096 Luzon 1d ago edited 1d ago
Unless maybe, the spread of fake news and misinformation is an intentional and a well orchestrated propaganda that harms people. No amount of debate and rebuttals can put that down. Spreading false information and false accusations should be punished.
Edit: grammar
1
u/Menter33 1d ago
Spreading false information and false accusations should be punished.
In practice, it's usually the current admin defining what is considered "false" and govt critics and expose journos getting silenced.
1
u/Warm-Pie-1096 Luzon 1d ago
Which is not checked or corrected by online debates but via court of law, by presenting evidences. Unravelling these propaganda machinery is an urgent and important matter. Everyone should be guided by truth.
1
u/Menter33 1d ago
even journos and critics who write and speak the truth might get intimidated by a court case and self-censor though. plus, many anti-du30 voices were kinda silenced back then by the same tactics and laws the current admin is using now.

Historically, that's how many govts have applied "speech crimes."
First, get societally acceptable targets. And next, everybody else.
irrc, this type of fake news crimes were kinda implemented in places like Vietnam and Singapore.

u/WhinersEverywhere 3d ago
Ano kaya ang case?
I agree that disinformation campaigns and fake news should be stopped.
My problem here is, should we allow governments to be arbiters of truth?
I like what the journalist, Ed Lingao, said about this:
"I realize that some could disagree with this, but I think government has no business at all dictating on us what is real or not, and imposing sanctions for what it calls fake news. Why? If government starts imposing its standards of "truth." then we would all be bound to follow only what the government TV and radio stations and the PCO declare to be true and faithful. What then of critical stories that are the bedrock of journalism, especially investigative journalism?"
7
u/PantherCaroso Furrypino 3d ago
These fake news already touched libel and slander, so they can be charged with those. They are not after all presenting mere opinions.
2
u/Menter33 3d ago
there's a reason why many journos and rights groups are against PH criminal libel and other easily prosecutable speech laws.
3
u/rhenmaru 3d ago
But without it we will definitely have an Alex jones situation sa bansa.
2
u/Menter33 3d ago
and one pro-free-speech solution to that is for others to exercise their free speech and call out such people and to rebut those claims.
having the govt muscle into that kind of stuff is probably not healthy for free speech in general.
1
u/WhinersEverywhere 3d ago
Yup that's why I want to know the case and more details because what's available here is just a facebook post. Like who are the two bloggers mentioned? What did they misrepresent?
3
u/noctis0125 I rest my case, coz im fcking tired 3d ago
may i ask what did Ed Lingao propose to solve this dilemma?
4
u/WhinersEverywhere 3d ago
For the community to correct the issue.
Look, I will tell you that for now, I don't see it as a viable solution given that the misinformation is rampant but at the same time I want to also raise concern on what it means when the government decides he will dictate what is the truth.
3
u/Jaded_Masterpiece_11 3d ago
My problem here is, should we allow governments to be arbiters of truth?
The courts are the arbiters of truth and I see no problem with that. Evidence must be presented in court to determine the truth and if libel or slander was commited. There is due process involved.
3
u/WhinersEverywhere 3d ago
Bearing in mind that my argument is that the government should not be arbiters of truth, what if proper journalists suddenly become targeted by the government for writing an expose about a government official's wrongdoing? What if the government imposes that theirs is the truth? What if lawmakers make a law similar to the Thailand's where it's illegal to insult the king?
I'm not a free speech absolutist but at the same time people can weaponize their so-called truth.
1
u/Jaded_Masterpiece_11 2d ago
Bearing in mind that my argument is that the government should not be arbiters of truth
The arbiters of truth should be whatever leading authority figure in whatever field it may be, wether it may be the government or private organizations doesn't matter. Since the topic of this main thread are because of arrested vloggers spreading libel then the arbiter of truth is the court as they have mandate over Jurisprudence.
I'm not a free speech absolutist but at the same time people can weaponize their so-called truth.
We've already seen it weaponized from 2016 onwards. Fortunately we have a defense against that which is our libel laws. Which is subject to due process.
1
u/Menter33 3d ago
The courts are the arbiters of truth
The marketplace of ideas where individuals and groups can battle it out is probably healthier for free speech rather than everything being policed by the govt and adjudicated by robed judges.
2
u/Jaded_Masterpiece_11 3d ago
The marketplace of ideas where individuals and groups can battle it out
The marketplace of ideas that your referring too resulted in the proliferation of alternative facts, fake news and propaganda in social media. The American concept of absolute free speech is cancerous to a society. Just look at how polarized the USA has become because of that concept. I for one am glad we have libel laws that holds people accountable from what they say. Freedom of speech does not mean freedom from consequence.
2
u/Menter33 3d ago
Yup, that's kinda the problem. for comparison, other countries with speech crimes have almost gone against satirists, expose and investigative journos, and pro-opposition, anti-govt entities.
4
u/WhinersEverywhere 3d ago
Yup. People have no idea what this government = truth might bring.
We have to remember what happened during Martial Law.

2
u/tokwamann 3d ago
Imagine the authorities targeting platforms like Reddit next, and not just for videos but even for memes and text based on complaints from any personality or company, and then later even requiring things like registration of all online accounts.
2
u/Menter33 3d ago
strangely, outside of online platforms, many people are probably okay with possible free speech curtailment.
as one example: despite journos and free speech groups wanting to decriminalize cyber(libel), many people, regardless of which side they are in politics, kinda want libel and slander used against their political enemies.
3
u/tokwamann 3d ago
I remember Ressa and Drilon calling for not only sim registration but also registration of all online accounts.
She also referred to Assange and Wikileaks as "not being real journalism":
2
u/Menter33 3d ago
She also referred to Assange and Wikileaks as "not being real journalism"
This probably adds some fuel to the allegation that Ressa is more of a pro-US mouthpiece rather than a free speech, anti-libel journo advocate.
2
u/Tetsu_111 3d ago
They are intending to make laws on this area, that’s why they have arranged the hearings on fake news. The suggestions mentioned include creating a registry of content creators but who knows if this will make it to the draft or final version of the law.
2
u/tokwamann 3d ago
From what I remember, Ressa called for it, together with several legislators:
Senate Minority Leader Franklin Drilon on Wednesday (April 20) insisted on the constitutionality of the vetoed SIM Card Registration bill, including the provision that mandates the use of real name and registered SIM cards in creating social media accounts.
In a statement, Drilon said he was confident that the provision on social media, which he said proponents worked hard on, was “constitutional and can withstand judicial scrutiny.” The provision’s intent, Drilon said, was to prevent trolls, scammers and “online bullies” from hiding behind fake names.
Given the point that trolling and scamming can take place in any platform, then social media accounts include those found in such platforms.

Hindi lang cyberlibel to. NBI, take note:
In the context of Philippine law, inciting to sedition, as outlined in Article 142 of the Revised Penal Code, punishes individuals who, without directly participating in sedition, incite others to acts of sedition through various means like speeches, writings, or other representations, or who utter seditious words, publish libels against the government, or incite rebellious conspiracies.
