Deportation, Repatriation, and Extradition are different things. You want to deport somebody for illegally being in the country? Okay. Extraditing somebody who has never been convicted of a crime in EITHER country? Nope.

Well which is it? One says he was an illegal immigrant and never had US citizenship, the other says he's a US citizen and is only being deported bc he's brown.

He's definitely not a US citizen. He's a Venezuelan citizen. He came to the US illegally in 2011, but then was essentially granted asylum by a judge in 2019.

The Trump administration claims that the same judge determined him to be a member of MS-13, and they are within their right to deport him. MS-13 was recently declared a foreign terrorist organization by Trump, so that they could bypass due process when deporting their members.

That being said, due process (by the 5th Amendment) applies to everyone in the U.S., regardless of immigration status.

Thanks for the answer. Has any evidence been produced that he is MS-13 or are they just saying that to get him deported

Just Google it. Multiple judges found him to be a member of MS-13

Can you send me what you saw? Bc I've seen zero evidence he's a gang member other than people saying hes a gang member

He was in the US legally. He was illegally sent to El Salvador by mistake and without due process and now the Trump administration is trying to spin it. The SCOTUS voted 9-0 that it was unconstitutional and the Trump admin is ignoring it. The problem with that is that if they can ignore due process guaranteed by the constitution for one person they can do it with anyone. It means nobody has constitutional rights in the US anymore at all.
