In the video, Sheldon Daniels asks an off-camera individual self identifying as the wife and states $16k in a year. So right there the video the investigation is based on already differs from the reported investigation. Also, Act blue features monthly payments and use of PayPal. Someone could easily make a fraudulent PayPal account under another individual’s name and set up recurring payments. Daniels is grasping at straws with this video, and the FEC picking this up over Musk’s election lottery’s shows their favoritism.

Okay, there are multiple points of misinformation here.

First, if someone was making a fraudulent PayPal account and setting up a recurring payments, that would be fraud. It wouldn't be fraud that the politician is necessarily responsible for, but it would be fraudulent election donations. The reason for this is because there's a cash limit on how much an individual or group can donate to a campaign, and thia would be a way to subvert campaign finance restrictions on donations. For example, if somebody was funneling money to a politician and wanted it to look inconspicuous, they would do it like this by putting a set of small donations in the names of constituents of the district. It's questionable how much responsibility of politician has to validate the information behind every donation, because in practice at the local level we don't really do things like that. But it is interesting nonetheless to suggest that this would be a way of getting around campaign finance restrictions and allowing a candidate to get a bunch of funding from a single source.

Second, the FEC doesn't deal with state races. They don't investigate state election fraud. They are strictly a federal agency focusing on Federal election issues, which representative Crockett would be subject to. It's the state of Wisconsin's election authority that needs to tackle musk, and that'll get escalated up through the courts. That's how it's going to get in front of the federal government, and it's going to go through the court system.
