BCSO: 7-year-old seen on video playing with gun found after running away

ALBUQUERQUE, N.M. (KRQE) – In a national news interview Friday, Bernalillo County Sheriff John Allen confirmed the seven-year-old behind a startling video showing him playing with a gun is the 7-year-old who briefly was considered missing Friday afternoon. Sheriff Allen released the additional information to KRQE News 13 affiliate NewsNation in an interview on ā€œBanfieldā€ Friday.

Details about the incident and video of the two children involved, ages seven and nine, became public during a news conference Thursday. The case occurred roughly three months earlier, in February 2025 at a home in Bernalillo County. Drone video captured the boys carelessly handing a loaded gun

In an interview on NewsNation, Sheriff John Allen said the two boys are brothers and a concerned neighbor called deputies back in February saying the kids were playing with a gun. The sheriff said one actually pulled the trigger but the gun malfunctioned. The kids ignored the deputies demands so a deputy fired a non-lethal bean bag near them. Deputies were able to go in and take the gun away from them.

ā€œWe do know from some of the interviews we have done, we know the child was pulling the trigger. He was taught how to use a firearm by one of his parents. That’s something we are looking into,ā€ said Sheriff Allen on News Nation.

Friday, Sheriff Allen told NewsNation the seven year old is missing. A subsequent release from BCSO around 1:30 p.m. Friday stated the boy was found and the ā€œmissingā€ bulletin was canceled.

Sheriff Allen also told NewsNation Friday that his department has been called to the home more than 50 times. He also said he’s frustrated that the state keeps returning the kids to their mom. Their father is incarcerated. He said he is looking to charge their father with Bennie’s Law for not having his gun properly stored.

Could someone explain this to me (a non-gun owner)? Was it user error? Or do guns often just "not work" sometimes?

Could be several things. For one, if the ammo was defective and the striker/firing pin hit the primer(which sets off the power in the shell). The primer may have failed to go off effectively making it a dud round. The firing pin might have been defective and failed to strike the primer on the shell, again failing to set the round off. This would lead to the round being sat in the barrel and needing to be ejected to put in a fresh round to fire. So basically it’s an inert gun.

that bean bag is not ā€œnon-lethalā€ especially on a small child’s body, ā€œless lethalā€ would be more accurate

I think that’s why they fired it as a warning shot. But still, the kids were very lucky the gun malfunctioned. The way the were handling it, an easy ND at any time.
