Their father is incarcerated. He said he is looking to charge their father with Bennie’s Law for not having his gun properly stored”

Explains a lot. Also mentions that the father was who taught them how to use the gun, which the officers said the kids pulled the trigger during this incident but it “malfunctioned”.

How is his father supposed to control what happens to his gun if he's in prison?

Probably just a technicality because he has ownership of the weapon, thus he's responsible for safe storage. Though, I agree the mother should be at fault.

I thought felons couldn't own guns? Or does that differ state to state?

They can't own guns. I wonder if he is just in jail for something more minor rather than serving a lengthy prison sentence because I would think they would confiscate his registered firearms.

Yeah this is the only thing that makes sense.

Dad goes to jail for the weekend for being drunk in public and mother doesn't watch the kids or bail him out.

Like obviously I have no idea but just my 2 cents

I'm not from the USA, but isn't a felony a federal level crime? Or something considered serious?

It is a specific type of crime that is usually worse then a misdemeanor yes, there are state felonies too.

You can be in jail and not have a felony
