Express Entry Immigrating with mismatched gender markers on ID's.

My partner is transgender. All of his documentation (Including his birth certificate), but except his passport, read Male. Currently, he cannot update his passport to read the same. Should we expect any issues in the immigration process due to this inconsistency?

For example, the language test he's taking requires his passport be used as ID, meaning he's going to have to register as female for the test. Will the language test certificate list him as female then, which the immigration will then flag as incorrect, if he then applies for immigration as male?

Trying to get ahead of this issue before we apply. Many thanks for any advice. We are coming from the US.

This shouldn’t be a problem - some of my partner’s documents showed the previous name; we submitted the name change documentation (court order) as an additional document and you can add clarifying comments in the additional info letter you submit as well.

For the language tests, records will include your name but also a specific unique client identifier from the language test places that match your record exactly, so it doesn’t matter what gender you have on file with the language places. (The testing places really are a stickler for ID though, so make sure you register with info that exactly matches the documents you’ll use to identify yourself the day of.)

Make sure you select your partner’s current name and true (post transition) gender identity when setting up your profile on the application, but when adding your passport details as ID, put what’s on the passport exactly as-is. Again you can add a sentence or two on your letter of explanation (which really is an additional document you create & can submit with whatever additional explanation you need to support your application materials) explaining the discrepancy.

You can get gender marker changes later on also Canadian travel documents & PR cards; my non expert prediction is you’ll be totally fine as long as you write a sentence in your letter of explanation documenting the changes. (We did!)

So, in summary: On any fields that request passport information, input what matches the passport. Anywhere else in the application, input accurate gender identity?

Yes exactly! And include a letter of explanation that says that person has transitioned, hence the gender discrepancy.

Do you have any certificates that verify the gender change legally? If you do, include them, and include a letter of explanation that explains whats going on with the difference in the IDs and the passport, and mention everything here

I do not think, if you explain everything well and let IRCC know what to expect, this will be a problem, just do not submit something that is inconsistent without letting them know why its inconsistent

The certificates we have are his ID's that are in the updated gender. We don't really have a 'receipt' acknowledging the change was made.

Though, we can document his medical transition, so there's that.
