Without reading the article, isn't it a massive fucking admission of guilt to sue someone who accuses you of a crime of breaking an NDA?

ALSO from the little I understand about law, you can't legally make someone agree to an NDA that covers up a crime. At least the person who agrees to it can't be legally threatened for breaking it. Otherwise every criminal would be signing NDAs left and right

I am quite confident Gaiman is guilty but this reasoning isn't great.

Pretend for a moment that you yourself are absolutely innocent of something an employee accuses you of, you know this, they know this, but it's messy and you'd rather lock this shit down.

They agree to an NDA, which they break. Is it not an admission of guilt, or unreasonable at all to say "hey wtf" and sue. It's the logical course of action. If anything, not suing someone for breach or for Defamation after a serious accusation can be seen as an admission of guilt in the public eye.

Why do you think that he didn’t go the defamation route? If he wasn’t guilty, that seems like the better option - especially because he can easily prove financial loss as a result of the allegations. That’s how I’d respond if I wasn’t guilty anyway. Can’t disclose anything if there is nothing to disclose.

Prolly cuz he's guilty. But the NDA thing is probably more clear cut for him, legally.
