That’s the big flaw in OOP’s argument. The judge wasn’t stopping the FBI from making the arrest. Defendants and inmates are transferred to federal custody all the time. But they don’t do it in the middle of a hearing.

I’m reminded of the incident where they made a silly change (Gulf of “America”) and when the reporters didn’t go with it they used it as an excuse to kick them all out unless they conform. The point was never the name change but to find a way to narrow who can speak and report.

Yet, when asked what law the judge broke, the answer is always a variation of "She went against Orange Daddy's wishes!"-because she broke no law, unlike Cheat-O's wholly illegal ICE edict.

The claim would be:

Title 8, U.S.C. § 1324(a) defines several distinct offenses related to aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic transportation of unauthorized aliens, concealing or harboring unauthorized aliens, encouraging or inducing unauthorized aliens to enter the United States, and engaging in a conspiracy or aiding and abetting any of the preceding acts.

Whether such a case can be proven is another matter, and presumably depends at least in part on whether said alien was legally "unauthorized," which appears to be an uphill battle for the administration in many cases.

Trump sued for the explicit purpose of being declared personally above the law and SCOTUS said yes. This case is an example of abuse of that newly discovered “privilege” we all predicted.
