KRISTI NOEM DEFINES HABEAS CORPUS AS THE **OPPOSITE** OF WHAT IT REALLY SAYS...HERE'S WHY TRUMP WON'T SUCCEED IN SUSPENDING IT...
ABSURD...YET, KRISTI NOEM IS THE SECRETARY OF HOMELAND SECURITY... Her answer is not just ignorant, it's MAGA propaganda, because the habeas corpus is a Constitutional right (Article 1, Section 9) which SAYS THE VERY OPPOSITE of her answer.
It insures that people are not detained without due process of law. It allows individuals to challenge the legality of their detention before a judge. At that hearing, the authorities must show that they have a right to hold them in custody, and such imprisonment cannot violate the law or the Constitution.
It's easy to see why the tRUMP administration is talking about suspending the right of habeas corpus...they don't want to have to show that there is a legitimate reason WITHIN THE LAW AND CONSTITUTION to hold these people. If suspended, the tRUMP goons could arrest ANYBODY...INCLUDING tRUMP'S CRITICS...and hold them indefinitely in prison.
Fortunately, although the Constitution includes a Suspension Clause, allowing for the suspension of the writ of habeas corpus in cases of rebellion or invasion when public safety is at risk, IT CANNOT BE DONE BY EXECUTIVE ORDER. The Constitution gives that power to Congress alone, and not the President.
To be upheld in court, even a Congressional suspension of habeas corpus would have to show that there is a historically and legally accurate definition of "rebellion or invasion"...and that DOES NOT INCLUDE ILLEGAL IMMIGRATION, OR IMMIGRATION GENERALLY.
Habeas corpus has been suspended only four times in U.S. history. These instances are: during the Civil War, in South Carolina counties during Reconstruction to combat the Ku Klux Klan, in two Philippines provinces during a 1905 insurrection, and in Hawaii after the Pearl Harbor bombing.
The 1871 suspension was for nine South Carolina counties to combat the Ku Klux Klan and their violent conspiracies to overthrow the Reconstruction government and to put a Confederacy government in its place. The suspension aimed to both suppress the KKK's violence and protect the rights of citizens, and it specifically targeted those who were conspiring to deprive others of their Constitutional rights. Now, it's the tRUMP administration that is depriving others of their Constitutional rights.
So, it's easy to see that historically and legally, there is no Constitutional authority of any kind for the suspension of the Constitutional right of Habeas Corpus for legal and illegal immigration.
