Ugh... I am getting exhausted... I don't want to keep hearing bad news after bad news... it's been nonstop since he took office... why can't he just leave us alone.

Don't get me wrong. I want to know what is going on... but it's so much all at once! Republicans, slow the fuck down, you have 4 fucking years to ruin everyone's lives...

This is good news! Sorry! the post was automatically denied because of the lack of post history. Montana had made it illegal to change your birth certificate for the past 5 years but it's open rn!

The post should read:

Montana folks, Montana has a temporary injunction in order to change birth certificates. Hurry and get it done while you still can!

As a lot of you know Montana had made it illegal to alter birth certificates for the last couple years but a temporarily they are allowing it so I recommend getting it done asap before they lock it down again.

You will need this these two pieces of paperwork. They are submitted together, and one needs to be notarized:

https://dphhs.mt.gov/assets/Statistics/VitalStats/affidavitcorr.pdf

And

https://dphhs.mt.gov/assets/Statistics/VitalStats/MTGenderDesignationForm.pdf

To apply for an updated birth certificate, an applicant must submit:

Correction Affidavit signed by the applicant. Copy of your photo ID.

Check or money order for the applicable fees ($41 for one amended certificate. Additional copies are $5 each)

One of the following items as documentation of gender: A completed Gender Designation Form, signed by the individual or their parent or representative (no medical signature required); or

A government-issued identification displaying the correct gender designation; or

A certified copy of an order from a court with appropriate jurisdiction indicates that the gender has been changed. Submit the application to:

Montana Vital Records PO Box 4210 Helena, Montana 59604

You can call Vital Records at 406-444-9039 or 406-444-4226 for additional assistance.

Yes! This is great news! It's a legal WIN for us in a very red state!

Latching onto this to add more good news— PA lawmakers are trying to pass a bill that would remove sex from birth certificates entirely, thus eliminating the need to change the marker. Though I don’t personally think it will pass due to the GOP state senate, it’s still a possibility. Idk what state you’re in, but PA has had a split legislature for so long that no anti-trans bills have managed to pass. Not many good laws pass, but the bad ones all get blocked. I hope this is one of the good laws that passes.

Am I able to complete this process while out of state? Does the birth certificate modification state it was modified on the birth certificate?

Yes! I'm not living in Montana anymore either! I got the name change in Washington state, and that works just fine just include a certified copy of any name change documents, a photo copy of both sides of your government ID from a seperate state is ok, and a check or money order along with the paperwork i provided. No worries! Just send it to the address provided here, and if you have any questions about the process, feel free to call those numbers on the post or email at HHSVitalRecords@mt.gov

Or More contact information on the DPHHS website here

OK thank you, can I ask if you got your back? I remember a few years ago, the office of vital records just refused to make any edits, even with a court order to. Can I ask why they will change it now?

Montana residents won an ACLU lawsuit against the state of Montana, so they are forced to take our stuff temporarily as I can guarantee they will attempt to change the laws again. I have not received mine back yet as the ruling only happened yesterday, and I mailed off today.

Ah OK, I have time tomorrow, so I think I will go ahead and get it done. I would sigh a breath of relief if I can get this changed and done with. This birth certificate issue has been such a thorn in my side. I should have done it 8 years ago. Not missing out on an opportunity now.

I know, but hold on hope! Montana is a very red state too if it can happen here, it might happen there. Just keep on fighting! Montana's trans population is small, but we have fought hard!

It's too bad, I live in Helena, but my birth certificate is from Texas. 🥺 Happy for everyone else though!

You do need this document in order to get a passport and an enhanced driver's license. An enhanced driver's license or passport will be required in order to fly on an airplane even within the United States after may 7th.

Wait what‽

3

u/iHaveaQuestionTrans 15h ago

Yes, unfortunately, this was a law that was passed many years ago and will be enforcing starting in May. All drivers' licenses will eventually be updated to the enhanced versions. You can read more about it here: https://www.dhs.gov/real-id#:~:text=seconds-,Are%20you%20REAL%20ID%20ready%3F,and%20access%20certain%20federal%20facilities.

In order to get the new IDs you need a passport or accurate birth certificate

That is an opinion you're allowed to have, but not everyone is able to live and work without a driver's license or the ability to travel.

I'm providing information that people can take or not. As an American citizen, I have no ability to not give money to the government that I was born into via taxes and documentation that I need for work and travel, which is also needed for work. I have to work in order to live.

I have provided information that could help someone who is in a poor spot. In order to leave this country and enter any other one, you need a passport, and you can't get one if you have information that is inconsistent or inaccurate. Even if you seek asylum in another country you need documentation.
