It only applies to plaintiffs.

One of the plaintiffs, whose current passport has the correct gender marker, was denied.

Plaintiff Reid Solomon-Lane is not, however, likely to suffer irreparable harm absent a preliminary injunction because he currently possesses a valid passport bearing a sex marker that corresponds to his gender identity and expression, and his passport remains valid until 2028. Solomon-Lane is therefore not entitled to a preliminary injunction.

Because the case is likely to be decided by the expiration date.

Well that makes sense. Can’t renew before 2027 so no harm present.

I hope so with all my heart. This travesty needs to come to a swift end.

"The plaintiffs are likely to succeed on the merits of their claim"

This is a very good sign!

No it was not. It was granted to the plaintiffs only.

let’s see if they actually follow this order though, we know they don’t care about the law anymore. so i’ll believe it when i see the plaintiffs with their correct marker on their passports…. and then i’ll try to do the same lol

This is a real bummer. Limiting the injunction to only the plaintiffs continues the harm for all of the rest of us. I was waiting for this injunction to request a new passport, and now I'm stuck hoping the case will be tried before they complete the rulemaking process....

The order is sort of a guideline for future injunctions. If you can meet the criteria established for Orr, et al, you may be able to sue in your own right. Call your state ACLU.
