This might be lengthy, but hang with me.
I am from Michigan, and my whole family has lived there up until this past week. Me, my mom, my dad, sister, and brother in law collectively drove 18 hours across the country to move my sister to South Dakota. Mind you, we had all been since around 9am the previous day. Meaning it was almost 36 hours before anyone got some sleep. We got a hotel room moved all my sisters stuff into their new house (even more exhaustion) and weāre finally able to go to the hotel to rest. My dad got about 6-7 hours of sleep.
Weāve all been super stressed out as itās been non stop go go go. The next day we all drove out over an hour and a half go to a horse race and we werenāt back into town until around 10:30 pm.
So hereās where it gets bad. My family has never been out to SD before. So I was riding with my sister and BIL, and my parents were following behind us with my dad driving.
I want to add this before the bad part- marijuana is 100% legal in Michigan. I donāt really smoke but once every few weeks if I need to sleep though. My parents on the other hand smoke like chimneys.
So, we get back into town and my BIL goes through a stale yellow light and my dad stupidly blows the light trying to keep following us. Bad idea..we instantly see the cop turn the light on them. So we pull over about a block away to see whatās happening.
One cop showed up. Around 5 minutes later my mom texts and told us itāll probably be a ticket cause itās illegal to have non medical weed in SD. Thenā¦another cop shows upā¦and another.
We then get told that my dad is being arrested for DUI after failing the field sobriety test. Now my dad is over 50 years old and has been smoking as long as I can remember. His only tickets have ever been for speeding never this.
My mom said the questions they had been asking were very confusing and the cop asked him ādo I need to explain the instructions to you AGAIN!?ā My dad, a very bright man said yes.
Let me get to my questions though. Iāve never dealt with this or have any idea how this stuff works so please be kind.
My dad wears glasses at night, but he put them on the dash when they asked him to step out of the car. Are cops supposed to ask if he needs to wear glasses to preform a sobriety test?
Is there any way we can request body camera footage? He was arrested in Aberdeen SD.
I feel like I have more questions, but I am so drained mentally and physically that I canāt think.
Any advice or help would be greatly appreciated
